Terms and conditions

These terms govern your use of the CleanTender service available at cleantender.co.uk. Please read them carefully. By creating an account or otherwise using the service you agree to be bound by them.

Who we are

CleanTender is a service operated by Cyber Phoenix Ltd, a company registered in England & Wales with its registered office at 124-128 City Road, London EC1V 2NX. In these terms, "we", "us" and "our" mean Cyber Phoenix Ltd; "you" and "your" mean the person, business, or other entity using the service. Contact: support@cleantender.co.uk.

The service

CleanTender provides:

  • A directory of UK public-sector Soft FM tenders — cleaning, security, grounds, waste, catering, pest control, laundry, reception and integrated FM bundles. Notices are curated from official UK public-sector sources.
  • AI qualification scans ("evaluations") that compare an individual contract against your stored company profile and return a 0-100 fit score, structured compliance gaps, and a submission checklist.
  • AI bid-draft generation that produces a structured Standard Selection Questionnaire response based on your profile and the contract you have selected.
  • Email tender alerts (Pro) when newly published tenders match your profile and threshold settings.

We may add to, remove from, or change the service from time to time. Where a change materially reduces the functionality you've paid for, we'll tell you in advance.

Your account

You need to register an account to use the authenticated features of the service. You must:

  • Provide an accurate email address you control.
  • Keep the company profile information you provide accurate and up to date — the qualification scan and bid drafts only reflect reality if the inputs do.
  • Keep your password confidential and not share your account.
  • Be at least 18 years old and authorised to bind the entity using the service.

You're responsible for everything done through your account. Tell us at support@cleantender.co.uk if you suspect unauthorised access.

Plans, payment, and cancellation

The service offers a Free tier and a Pro tier. Pricing is published at cleantender.co.uk/pricing and is the price you'll pay until we update it.

  • Free — browse the tender directory and read published guides. No qualification scans or bid drafts.
  • Pro — currently £99 per month or £990 per year. Includes up to 30 AI qualification scans per calendar month, unlimited bid-draft generations subject to fair-use rate limits, daily tender alerts matched to your profile, and the Compliance Vault.

Pro subscriptions renew automatically until cancelled. You can cancel at any time from your account; the cancellation takes effect at the end of the current billing period and you keep access to Pro features until then. We do not refund partial periods unless required by law (for example, the 14-day Consumer Contracts Regulations 2013 cooling-off period for individual consumers in the UK; if you start using the Pro features inside that window you waive the right to cancel for the work already performed).

We may change Pro pricing with at least 30 days' notice for existing subscribers. If you don't want to continue at the new price, cancel before it takes effect.

Evaluation cap and rate limits

Each Pro subscription includes 30 AI qualification scans per calendar month. The cap resets at 00:00 UTC on the first day of each month. Scans that fail before producing a result do not count against the cap. Re-running a previously-evaluated contract counts as a new scan.

Bid drafts are unlimited but rate-limited to 5 generations per 60 seconds per account to prevent runaway use. Repeated abuse of the rate limit may result in suspension.

AI output — what it is and isn't

The qualification score, missing-compliance list, submission checklist, and bid drafts are generated by a large language model based on the contract pack and the data you've entered into your profile. They are decision-support tools intended to save time and surface issues. They are not:

  • Legal, financial, regulatory, or procurement advice.
  • A guarantee that you will or won't win a contract.
  • A substitute for reading the tender documents in full.
  • A substitute for professional bid-writing where the tender warrants it.

You are responsible for everything you submit to a buyer. Always read the tender pack, verify factual claims, and have a person competent in your business sign off the bid. We're not liable for decisions you make on the basis of our output.

Acceptable use

You agree not to:

  • Misrepresent your identity, your business, or your compliance status in your profile.
  • Scrape, mirror, or redistribute the contract directory or any other content from the service in bulk, by automation, or otherwise without our written permission.
  • Reverse-engineer, decompile, or attempt to derive the source code of the service or to extract the underlying prompts or model parameters.
  • Use the service to generate, transmit, or store unlawful, defamatory, infringing, or harmful content.
  • Use the AI features to attempt to extract personal data about other users or to generate output for any purpose unrelated to bidding for legitimate contracts you intend to deliver.
  • Submit deliberately misleading inputs designed to bypass our rate limits or evaluation cap.
  • Use the service in any way that violates UK law, the Computer Misuse Act 1990, the Modern Slavery Act 2015, or sanctions.
  • Resell or sub-licence access to the service.

Intellectual property

We retain all rights, title, and interest in the CleanTender service, including the website, the qualification engine, the drafting prompts, the editorial content of our guides, and the aggregation and curation of the tender directory. Tender notices published by UK public buyers remain Crown copyright or the relevant buyer's copyright, used by us under the Open Government Licence v3.0.

You retain ownership of the data you enter (your profile and your generated drafts). You grant us a worldwide, royalty-free licence to host, process, transmit, and display that data solely to operate the service for you. We don't use your prompts or your drafts to train models.

You're free to use the bid drafts the service generates for the tenders you submit. Each draft is yours.

Tender alerts

Pro subscribers can opt into daily tender alerts. We use the sectors, regions, and value band you've set in your profile, plus the match-score threshold you choose, to filter the daily ingest and email you only the matches that clear your threshold. You can disable alerts in your dashboard at any time, or use the one-click unsubscribe link in every alert email.

Limitation of liability

Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that can't be excluded or limited under UK law.

Subject to that, our total aggregate liability to you arising out of or in connection with the service in any 12-month period is limited to the greater of £100 or the fees you actually paid us in that period.

We are not liable for: lost profits, lost revenue, lost business opportunities, lost contracts you didn't win, lost goodwill, wasted bid-writing time, indirect or consequential loss, or for any decision you make on the basis of an AI output. The service is provided "as is" and we don't warrant that it will be error-free or uninterrupted.

Your indemnity to us

You'll indemnify us against any claim brought by a third party arising from your breach of these terms or your misuse of the service, including claims that information you submitted to a buyer was inaccurate, fraudulent, or infringing.

Suspension and termination

You can close your account at any time from your profile. We may suspend or terminate your account if you breach these terms, fail to pay subscription fees, or use the service in a way that's materially harmful to us or to other users. We'll give you notice where reasonably possible.

On termination, your access to the service ends. We delete or anonymise your account and profile data in line with the retention periods set out in the privacy policy. Saved bid drafts and evaluations are deleted within 30 days unless you've already downloaded them.

Data protection

We process personal data in accordance with our privacy policy, which forms part of these terms. We're the data controller for the data you provide. Where you input personal data of third parties (for example, referee contacts in your free-text profile description), you confirm you have a lawful basis to share it with us.

Changes to these terms

We may update these terms when our service or the law changes. The "Last updated" date at the top reflects the most recent revision. We'll notify registered users by email of any material change before it takes effect. Continued use of the service after a change means you accept the updated terms.

Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction.

General

  • If any clause of these terms is held to be unenforceable, the rest stays in force.
  • Our failure to enforce any right isn't a waiver of that right.
  • You can't assign your rights under these terms without our written consent. We may assign ours to an entity acquiring our business.
  • These terms, together with the privacy and cookie policies, are the entire agreement between you and us regarding the service.
  • No third party has any rights under the Contracts (Rights of Third Parties) Act 1999.
